Marriage contract with a payment in case of divorce

Imâm Sâlih bin Fawzân al-Fawzân

Question: Is it correct to write in the marriage contract that the husband will pay for example 40.000 riyals in case of divorce, taking into account that that money has nothing to do with the wedding gift at the beginning?

Answer: That condition is invalid. A man can keep a woman if she is kind to him and he can divorce her if she is not kind to him – without paying her anything. He just needs to pay for the wedding gift.
